They are Nestle. I noticed this when reading the bags of trick or treat candies.
I'm probably just echoing a lot of these, but this is what I would use:
Tootsie rolls. CHEAP (a bag for a buck at $Tree) - yummy, chocolatey and GOOD.
Hershey Stix - Do people still eat these? Last I knew they were safe. I haven't checked lately.
Dum Dums (I use the ones with the chocolate chewy center, they say on the back that they have none of listed allergens, that proves that they're serious, imo!)
Dots - are these safe? I thought they were!

I found them at our local Giant supermarket in a display box. I am in southeast Pennsylvania. They seem to be sold individually and are about 4 inches tall. They are similar to the Santa ones sold at Christmas in the 6 pack.

Peeps has something new this years - bags of individually wrapped Spooky Peeps. They are very cute! I've seen them all over, K-Mart, Target, and grocery stores.
Also saw bags of little, individual York peppermint patties, shaped like pumpkins with orange filling.
FYI--[b]Hershey Jolly Rancher Creepy Pops[/b] are mislabeled.
The bag does not have any may contain info on it, but the individual posps say:

I am in the US, and I know of at least one person in Canada who has seem the same thing. I've called Hersheys, and they were apologetic and grateful I called to let them know.
I'll make a post specific to this warning.
What do folks think about Hershey's Kit Kats? They say peanuts are in the same facility but says nothing about them being on the same equipment.
We do not use kit kats. i know one PA mom that does let her child eat them.
