pMy son is 8 years old has been out of school for 6 months now due to his life threatening allergies, and his safety being an issue in school. My son has been tutored since 10-03-00 but yet has not been graded. I have had D.C.F. called on me for educational neglect, the investigation ended unfounded. Since my son was being tutored according to the State statutes. It has been a total nightmare since this whole situation started in 9-2000. I have hired an Attorney and I am fighting the whole School system in my town in Connecticut. I am going to the state to fight for my son and any other child that has life threatening allergies. The IGNORANCE has to end. Our kids are not safe. My son/p

You can apply to your state board of education and school your child at home in almost any way you choose, including "unschooling". Therefore, I would not worry about "educational neglect". You are not doing your child a disservice! Of course the laws differ in each state. Check out the homeschooling threads. I realize homeschooling may not be an option you wish to pursue for the long-term, but it is an option. I know many people who are doing it, including me, and love it. I wouldn't want it any other way. I personally am not comfortable with a schools ability to keep a PA child safe.

to Lynn,
i live in Connecticut also, my youngest (the one who is extremely allergic to nuts, i mean she can't even smell a nut) is becoming school age soon. i spoke to the board of ed they haven't got a clue, they treat this as if all that would happen would be a rash, they don't believe this condition is fatal. i only have one hope, a catholic school in my town is a nut-free school. now i am hoping and praying that this school will accept my daughter, it is the only place that she can be safe.
here is my e-mail address, maybe we can do something to make schools safe; mheyer9522@aol.com

Just read your post and it disturbs me that the school is not being helpful!? I live in NJ and it is a state law that any chiled that has a life threatening allergy must have a delegate. This means that a teacher is selected and willing to; will be responsible for the child. In my case my 8 yr old severely PA son has been very safe in school. This particular teacher is only assigned to him and she has to take a training course. She must be certified in CPR, trained in the administration of his epi-pen, and implementation of the EMS system. May be your lawyer should look into the laws of your state and see if there can be an amendment or change to make this law in your state as it is in mine. It sure helps me breathe a little easier...not alot but it does help knowing I have someone watching him when I'm not there. (It happens to be one of his favorite teachers too!) Good Luck and God Bless.

Thank-You for your reply and your information. My town does not want to deal with my son's life threatening allergies. When I called the superintendent he told me to put my son in another town.

Lynn, what a terrible thing for the superintendent to say! It is the school district's responsibility to provide your son with a "free and appropriate" education. He/she cannot tell you to go to another town. It sounds like you need an advocate or maybe even a lawyer. Some school districts provide advocates so you might want to call around and see if your district provides this service.

Lynn,
Can you tell us what exactly the school has done? I'm very fortunate that my son's school has been very understanding and has worked with us in keeping him safe. He's only in kindergarten, so I hope that trend continues for the next 12 years. Any advice or info I can share I will gladly do.
Susan

Susan, I am unsure of which part you want to know exactly what happend. It is our kids right to a free public education. Part of that is being safe in school. If faculty are not properly trained in Anaphylaxis shock and a epi-pen are kids are not safe. Just being trained with the epi pen is not good enough.Every child that has life threatening allergies reacts differently. My sons Doctor has stated due to the severity of my sons allergies what would be best for him is to have one person in charge of him. What my sons school has done is give him an aide that CANNOT give him his medication if needed. She is to walkie talkie someone that is able. This is not aceptable to me or his Dr.
