Fine, thank you, Rhonda. Just VERY tired coming off a LONG baseball/softball season with the kids.
I'm keeping up with this thread learning something new everyday.

Synthia, if this thread helps anybody in anyway, thread topic or not, I consider it an honor. Ask whatever you need to ask in this thread as well. Completely understand no matter which thread you ask in.

to quote from the article:
"Respondents sought relief not only under the Education of the Handicapped Act but under 504 of the Rehabilitation Act as well. After finding petitioner liable to provide CIC under the former, the District Court proceeded to hold that petitioner was similarly liable under 504 and that respondents were therefore entitled to attorney's fees under 505 of the Rehabilitation Act, 29 U.S.C. 794a. We hold today, in Smith v. Robinson, post, p. 992, that 504 is inapplicable when relief is available under the Education of the Handicapped Act to remedy a denial of educational services. Respondents are therefore not entitled to relief under 504, and we reverse the Court of Appeals' holding that respondents [468 U.S. 883, 896] are entitled to recover attorney's fees. In all other respects, the judgment of the Court of Appeals is affirmed.
It is so ordered. "

just to update:
The school rep contacted me today and wants to meet with the nurse and possibly teacher later this month. She is unsure as to whether or not the IEP team can meet before school starts as she is not able to contact all of them yet. I asked for a confirmation of our conversation in writing. What's your take on this?

Hi MB,
Of course the IEP team can meet before school starts. In most districts around the country, schools have 3 or 4 professional development days prior to children entering the building. By contract, all school personnel must be working

Hi MB,
I do not know if you are familiar with this article, but parents use it here in CT to support the need for prevention and not just emergency response. It is a good article to cite when the SD says that a parent is being overly cautious with precautions. My response it that epinephrine does not always work, therefore we must focus our attention on prevention and emergency response (education and awareness).
