Peanut-Free Schools Against the Law?!

Does anyone know the answer to this-Are peanut-free schools "Against the Law"?

Our PA/TNA daughter is entering Kindergarten next year, and to begin the process of understanding our local public elementary school's policy on peanut-allergic kids, I placed a call to the ISD 504 Co-ordinator.

I asked nice, innocent questions in a nice tone the whole time, and was met with a less than kind, somewhat defensive woman who said "Yes, your child, with the proper medical paperwork would qualify for a 504 plan, but don't ask for your school to become peanut-free, because that is against the law". I was really stunned with this response because I hadn't even brought up the subject!

When I questioned her further on this, she said that schools can ask families to not bring peanut products, but legally people can still bring it.

I was wondering if anyone has heard of what law she is referring to. I was so surprised by her response and attitude, that I didn't think to ask her, and I don't really want to call her back again. I think I will just go to the school principal, since I am realizing that the principals have all the authority in their respective schools in our ISD.

I'm trying not to be discouraged. Can anyone shed light on this issue?

Thats a new one to me. It must be included in that amendment to the constitution that states "My child has the [b]right[/b] to bring a p.b. sandwich to school!" What a bunch of crap.

Actually the school has a legal obligation to keep your child safe and not discriminate against them.

If peanut free schools are illegal there must be a lot of schools that are operating illegally. I dont blame you for not calling her back! What a *****! Go to your principal or her boss.

I have not heard anything about this being against the law and I know it is policy at many schools to be nut free.

You should definitly start your 504 before the school year is over this year and figure out what you want the school to do for you!

Utter nonsense. Ask her to support her statement with legal citations. I am sure we would all be very interested in her response.

I have to think that she said it because you want to be protected under the 504 due to calling PA a disability. It almost sounds as if someone has already tried to get the school to be peanut free and had somewhat of a battle with it!!

Be careful with this one. If I were you, I would start keeping a diary of what was said, who said it, what time was the call, etc. etc. I would also immediately talk with the Principal ONLY about this particular incident.

Play dumb and ask the Principal if it was true that it is illegal? You might be
surprised at what your answer will be!

This woman sounds like she has a real chip on her shoulder. I would have sweetly asked her the exact citation "for my records." Then I would (most likely) watch her flounder and ask to speak to her superior. Why are people such ^%&*(()&& when all we are doing is trying to keep our kids from FALLING over dead at school? Sorry, I'm in a less than forgiving mood today.

If anyone has the naems of the nut-free schools, I'd be interested. I'm in the process of trying to take on the Board of Ed in my town and would like some back up information.
