We are working on the airline issue and need a link (or whatever) to the wording and where it is located in the ominbus bill re: peanut free zones etc. Written into the omnibus bill to stop us from having peanut free zones etc. on airlines back around Feb 1, 1999.

Any other information which you have, or can find which you think is relevant and would help those working on this issue please post (or e mail to me). The volunteers will be watching this post for your information (as well as receiving info by e mail from us).

Thanks in advance and the work you do on this will help us all!

H.R.4328 A bill making appropriations for the Department of Transportation (and dealing with those with peanut allergy)

>>>
(Sec. 372) Prohibits the use of funds to enforce any regulation or law that requires an air carrier that provides intrastate or interstate air transportation to provide a peanut-free buffer zone or any other related peanut-restricted area, or restrict the distribution of peanuts, until 90 days after submission to the Congress and the Secretary of a peer-reviewed scientific study that determines that there are severe reactions by passengers to peanuts as a result of contact with very small airborne peanut particles of the kind that passengers might encounter in an aircraft.

(you can look down on this page linked above after you go to it and you will find

(You can also do a search of this page for "peanut" from your computers "edit button" and clicking on "find on this page" feature of windows after you go to the H.R.4328 page. to find the wording quickly)

Chris-Have any studies been submitted to Congress yet on this bill from 2 years ago? John McCain's letter above states that this "prohibits the DOT from implementing its interpretation of regulations governing "peanut free" zones." Isn't H.R. 4328 just saying Congress has decided at this time not to appropriate money to enforce peanut restrictions, which they seem to admit is a regulation or law?
I've looked at 14 CFR 382, DOT Code of Federal regulations. 14 CRF 382.7(c) states, "Carriers shall, in addition to meeting the other requirements of this part, modify policies, practices, and facilities as needed to ensure nondiscrimination, consistent with the standards of section 504 of the Rehabilitation Act, as amended. Carriers are not required to make modifications that would constitute an undue burden or would fundamentally alter their program." (I'm sure I'm not telling you anything you don't know). But,isn't it generally accepted that peanut allergy can be a section 504 disability? So shouldn't it be considered a disability under 14CFR382? What can we do about this? I know you have asked for reaction stories, I don't have any, and am hoping never to have any. Can we do anything else?

There are volunteers working on this issue and I will ask them to post more about this when they are able. Some of what they are doing has to be timed right so they may not want to post yet. They are members and read these boards so I am sure they will see your post, and also next time I speak with them I will ask them to post what they can. They send us e mail updates and info such as any correspondence they have with lawmakers and airlines etc.
