Well, I finally got a letter from my son's allergist explaining the seriousness of his allergies and recommending a nut free classroom, first step towards requesting a 504 designation. Unfortunately, the letter is not as detailed as many I have read here, but my allergist is reluctant to become oppositional with the SD until I have made a concerted effort first and not received cooperation from the school. Okay, I'm fine with that. The school does have a lot of good things in place to keep my son safe, EXCEPT;

and this I don't understand. I brought the letter up to the nurse and again stressed his classroom be a nut free zone.

Her response: It IS a nut free zone! Definitely! But when I pressed her further she admitted that if a child brought in a peanut butter sandwich or a peanut butter cookie, there was nothing they could do, they would just sit the child at a different classroom table in the room and make him/her wash hands afterwards.

So, I ask you, does that sound like a nut free zone? It doesn't to me, but she keeps insisting it is! Her argument is they can not guarantee 100% peanut products won't be brought in.

So, what are they saying, because I am confused.

sounds like they are avoiding the commitment - trying to avoid liablity. Moving ahead with more things spelled out in a 504 will either help you define what it means or make them harder to deal with.

My district would not define what Peanut Free / Tree Nut Free meant - so we homeschool....of course they should be paying our expenses then!!!!!

When we were at school they were supposed to clearly mark the room as Peanut Tree nut free. So they made a small sign - that blended in with all the other artwork outside the door, and it had a peanut picture and a red circle around it with the slash - a picture, but not the words - and also nothing about other nuts not being allowed. I thought it was a total joke!! Sure the K kids couldn't read but their parents could.

Also the room was being used afterschool by scout groups and those groups were not notified it was a nut free zone. Then the school told me no one else but my scout group was using the room. When I knew and was already talking to the other scout groups that were using the room!!!!! School continued to tell me no one else was using the room.

A big caution to others using the room!!

I could not get our classroom labled *nut-free* but I could(after many meetings with the 504 team) them to put in writing that they would remove the food(any of his allergens) from the classroom if someone brought it in(by either replacing their item with somethign safe, or having them eat outside the classroom and wash and return). That was enough for me...but it took a fight to get.

ps they had their school lawyer there, he agreed there is NO law that says they can't replace the allergen food brought in or have the child eat and return after...NO law forbiding this.

That does not sound like a nut free zone to me. Your school has no back bone apparently.
If they are going to call the room NUT FREE, then they should be prepared to make it so.

That is just common sense I think.

Sorry this is happening to you.

EXACTLY the situation I have right now.
They ask parents to try and not send in snacks with pn/tn, but they don't really put out the way to determine that.
Right now, our school is under construction and they have to still fulfill gym time. So when the weather is bad, they will eat lunch in their classroom.
They also switch classrooms for math. I am worried about my son sitting at someone else's desk. He had hives on Monday (first switch for math) and I wondered if he came in contact with something. The nurse said even though there are no nut allergies in the other two classes, they are still checking snacks in those rooms and cleaning up immediately.
I have 504 accommodation meeting tomorrow and I am asking for a designated nut/peanut aware, free whatever you want to call it, zone.
It is confusing to many parents.
