The middle school my son will be attending in the fall will no longer protect him under the 504. He is an airborne allergy, and is very severe. We just had his bloodwork repeated and he is much worse than he was. Does anybody know of any financial aid under the 504 plan that will help us get financial help to send him to a much smaller school that WILL help?
Am trying to do fast research, as we only have a month or so left to do something, and did not realize until this week that he had gotten much worse. He can't even be in the same room as peanuts or peanut butter because the smell of it alone will cause him to stop breathing.
Thank you for any help you can give!
Tanya

You know this is exactly what I was thinking about regarding my own son. Under section 504, they have to provide appropriate accommodations and if they can not, schools can be held to providing an alternative placement. While alternative placements for food allergic children is still a very new and "unchartered" territory, it is done regularly for children with all kinds of disabilities. What probably would be helpful to you is to look into legal counsel specific to children with disabilities (IDEA and Section 504). They may or may not have experience in applying it to food allergies, but the law does state that FA are legally considered a hidden disability, so I'm sure they could help you navigate this option. You could, in addition, consult the OCR for information on this, as they are the governing entity for 504s. I hope that this helps and doesn't confuse you further. Good luck and keep in touch on what happens!
