Authorization form - can\'t be right!
Hi all! I've been having a heck of a time getting my daughter's school to accomodate her severe peanut allergy. She's in first grade. We started school August 8th. It took me two weeks before school started and the first two days of school to get a peanut free table. (And the principal lied to me that she had one when she didn't. It wasn't until I was coming in to check that she actually got one.) Now they are fighting the 504. It's been a big pain.
But what I'm posting for is this -
I took her medicine in to school Thursday and they asked me to fill out an Authorization for Administration of Medication form. No problem! Until I read this -
"We agree that the **** County Public Schools, and its employees
shall not be liable or responsible for any illness or damage to any person or property which may results from the storage of medication, from giving our child medication, [b]or from failing to give our child medication[/b]." That is the way it was written - grammatical errors and all.
Um, they're NOT liable if they FAIL to give my child medication??
Are you kidding me??? I refused to sign. I called the school district Friday and they said I either sign the form or she cannot have medications at school. So I called the state (we live in Georgia). The lady I spoke with was appalled and told me I could cross off that one phrase and sign it, but to make sure to check with a lawyer on how to do it. I went to a lawyer and learned that the lawyer was TERRIFIED to even talk about the school. I told him I wasn't there to talk about suing, I just wanted help with this form.
Long story short - they could not accept the form. Then what do I do?? How can it be that the school has no liability? If I didn't administer the EPI pin when she reacted here two years ago I would be in jail now. But they can "fail" to give her the medication and they have no accountability?
